Prisoners who violated nobody's rights

SEC. 13. It shall be the duty of every carrier to make a record at the place of shipment of the receipt of any liquor transported, and he shall deliver liquor only to persons who present to the carrier a verified copy of a permit to purchase which shall be made a part of the carrier’s permanent record at the office from which delivery is made.

The agent of the common carrier is hereby authorized to administer the oath to the consignee in verification of the copy of the permit presented, who, if not personally known to the agent, shall be identified before the delivery of the liquor to him. The name and address of the person identifying the consignee shall be included in the record.

SEC. 14. It shall be unlawful for a person to use or induce any carrier, or any agent or employee thereof, to carry or ship any package or receptacle containing liquor without notifying the carrier of the true nature and character of the shipment. No carrier shall transport nor shall any person receive liquor from a carrier unless there appears on the outside of the package containing such liquor the following information:

Name and address of the consignor or seller, name and address of  consignee, kind and quantity of liquor contained therein, and number of the permit to purchase or ship the same, together with the name and address of the person using the permit.

The meaning of the term "duty" is the moral necessity to perform certain actions for no reason other than obedience to some higher authority, without regard to any personal goal, motive, desire or interest.(link) 

When men with guns require you to buy a permit to purchase something, that is the antithesis of free, uncoerced exchange of values by mutual consent. Observe that States which adopt this practice do not send openly armed uniformed officers to make the necessary threats of violence and collect the fees. Instead, these agents tend do be "plainclothes," that is, disguised in the manner of secret police employed by totalitarian régimes. Depredation via this sort of mimesis also uses ordinary citizens as human shields. This--like the National Socialist practice of mass-killing civilians in retaliation for resistance--makes it difficult to neutralize the violence of this sort of "law."(link) 

When a monopoly on the use of force shirks the protection of individual rights to instead extort cash and obedience from service providers, freedom is destroyed. The law of supply and demand relies on the willingness of persons to participate in transactions which increase the wealth of nations. The result is impoverishment, as demonstrated when the Comstock Laws of 1873 turned the Postal Monopoly into an agent of book-burning superstition, censorship, fines and imprisonment.(link) The Panic which followed is what they called sudden mass impoverishment before Crash and Depression became the fashionable Newspeak. Prohibition laws had this same effect in 1907, 1920 and 1929-33.

The expression "It shall be unlawful" is, when applied to production and trade, a promise to send armed brutes to kill as many people as necessary to instill terror in the survivors and obtain their obedience. No such thing is ever needed to enforce legitimate laws against such actual crimes as murder, robbery and looting.  Is it any wonder that the U.S. economy crashed promptly when the Volstead law became enforceable, then again when "increased penalties" were added in 1929?

Esse sistema online permite gerar gráficos individualizados por estado dos EUA, de forma a descobrir que os estados mais populosos--Massachussetts, Connecticut, Pennsylvânia--deportam mais brasileiros nesse mesmo intervalo de tempo. 

Separando os dados por país, dá para reparar que tão logo o George Waffen Bush foi eleito, teve início uma série geométrica de deportações de brasileiros e brasileiras. Mas houve ao mesmo tempo os atentados contra arranha-céus por outros fanáticos religiosos, fato que gerou um verdadeiro tsunami de deportações de tudo quanto é estrangeiro, com crista da onda em 2005, mas bem mais baixa no todo do que a de 1998. 

As deportações do Iraq, de tamanho comparável a um estado brasileiro, foram menores em número mas numa grande vaga entre 2001 e 2013, que nem surpreende na esteira dos atentados. Os governos possuem uma inércia interna, e seria difícil argumentar que o surto de brasileiros seria resultado não dos atentados e sim de alguma fuga de suposta ditadura comunista do Lula ou de o Bush atiçar os agentes em cima dos brasileiros.

Salta aos olhos, mesmo assim, que na campanha democrata do Obama houve queda na expulsão de brasileiros. Chilenos também mostram uma tendência paralela, logo, é bem possível que o partido dos nacionalistas cristãos nada libertários, quando se apodera de maioria no governo americano, trata de despachar em maior número os que querem abandonar os países mais socialistas. E quem é que não prefere uma constituição curta, enxuta, e regida por uma carta de direitos bem específica?

Victimless "crime" laws bring lawyers more clients. 

SEC. 10. No person shall manufacture, purchase for sale, sell, or transport any liquor without making at the time a permanent record thereof showing in detail the amount and kind of liquor manufactured, purchased, sold, or transported, together with the names and addresses of the persons to whom sold, in case of sale, and the consignor and consignee in case of transportation, and the time and place of such manufacture, sale, or transportation. The commissioner may prescribe the form of such record, which shall at all times be open to inspection as in this Act provided. 

SEC. 11. All manufacturers and wholesale or retail druggists shall keep as a part of the records required of them a copy of all permits to purchase on which a sale of any liquor is made, and no manufacturer or wholesale druggist shall sell or otherwise dispose of any liquor except at wholesale and only to persons having permits to purchase in such quantities. 

SEC. 12. All persons manufacturing liquor for sale under the provisions of this title shall securely and permanently attach to every container thereof, as the same is manufactured, a label stating name of manufacturer, kind and quantity of liquor contained therein, and the date of its manufacture, together with the number of the permit authorizing the manufacture thereof; and all persons possessing such liquor in wholesale quantities shall securely keep and maintain such label thereon; and all persons selling at wholesale shall attach to every package of liquor, when sold, a label setting forth the kind and quantity of liquor contained therein, by whom manufactured, the date of sale, and the person to whom sold; which label shall likewise be kept and maintained thereon until the liquor is used for the purpose for which such sale was authorized.

The Fourth Amendment was written to preclude government agents goosestepping into privately-owned premises to paw through papers. By 1924, the Marron case out of San Francisco was headed to the Supreme Court. There, the new Force Amendments (Manifesto income tax and eugenic Prohibition), tossed the Bill of Rights out of the nest of government like a cowbird killing off siblings.(link) 

The Pure Food and Drug Act of 1906 was sold to the populace as truth in advertising. But it immediately became a mill of self-incrimination into fines, forfeitures and prison terms based on arbitrary labeling rules invented by bureaucrats. The law took effect in 1907 and by fall of that year the Panic of 1907 had wrecked the economy into a lengthy depression.(link) By blaming the imaginary hobgoblin of "speculation," Teedy Rosenfeld deflected scrutiny of the real cause of the Panic, Crash and Depression.(link) Camouflaging the causal effect of prohibitionism made it possible for the mistake to be repeated. Instead of informing consumers, labels soon  identified heretics for the wrath of ignorant mobs.(link)

"All persons" is another fiction, because cops and dry agents promptly formed liquor rings and, when caught, demanded immunity from prosecution, just like today.(link)

Guilty until proven innocent, 1925 (link)

SEC. 9. If at any time there shall be filed with the commissioner a complaint under oath setting forth facts showing, or if the commissioner has reason to believe, that any person who has a permit is not in good faith conforming to the provisions of this Act, or has violated the laws of any State relating to intoxicating liquor, the commissioner or his agent shall immediately issue an order citing such person to appear before him on a day named not more than thirty and not less than fifteen days from the date of service upon such permittee of a copy of the citation, which citation shall be accompanied by a copy of such complaint, or in the event that the proceedings be initiated by the commissioner with a statement of the facts constituting the violation charged, at which time a hearing shall be had unless continued for cause. Such hearings shall be held within the judicial district and within fifty miles of the place where the offense is alleged to have occurred, unless the parties agree on another place. If it be found that such person has been guilty of willfully violating any such laws, as charged, or has not in good faith conformed to the provisions of this Act, such permit shall be revoked, and no permit shall be granted to such person within one year thereafter. Should the permit be revoked by the commissioner, the permittee may have a review of his decision before a court of equity in the manner provided in section 5 hereof. During the pendency of such action such permit shall be temporarily revoked.

Observe that allegations are given factual weight by appeal to a hand on the Bible, and "facts" or "complaints" are interpreted as whatever the commissioner wants to believe, namely, "charges." Section 5, as we've seen, is similar palming off of faith-based assumptions.(link) The predictable result of putting such absolute and unquestionable power in the hands of thralls of pseudoscience and mysticism took only five years to metastasize into the sort of nationwide totalitarian meddling endemic to Russia, and that would soon spread across Germany, thanks to the pseudoscience of eugenics and burden of proof of innocence where evidence is a subjective feeling.
